Terms of Service

These Terms of Service apply to the use of etmhq.com and to the marketing services provided by ETM MARKETING LTD, a company registered in Cyprus under registration number HE 498361, with its registered office at Efesou 9, Paralimni 5280, Famagusta, Cyprus (“we”, “us”).

1. Business clients only

We provide our services exclusively to businesses acting in the course of their trade or profession. We do not provide services to consumers. By engaging us, you confirm that you act on behalf of a business.

2. Our services

We provide digital marketing services, including planning and managing paid advertising campaigns on platforms such as Meta and Google, creating ad content, and reporting on campaign performance. The scope, deliverables, fees and timing of each engagement are set out in a separate written agreement or statement of work. If that agreement conflicts with these Terms, the agreement prevails.

3. Fees and payment

Fees, advertising budgets and payment terms are agreed in writing for each engagement. Unless agreed otherwise, invoices are payable within 14 days of the invoice date.

4. Your responsibilities

• Provide accurate information, materials and timely approvals.
• Ensure that the products, services and materials you ask us to advertise are lawful and that you hold the rights to any materials you supply.
• Comply with the terms and advertising policies of the platforms on which your campaigns run.

5. Advertising platforms

Campaigns run on third-party platforms such as Meta and Google, which are subject to their own terms and policies. We are not responsible for decisions taken by those platforms, including ad rejections, account restrictions, changes to their systems or outages.

6. No guaranteed results

We carry out our services with reasonable skill and care. Advertising results depend on many factors outside our control, so we do not guarantee any particular outcome, such as a level of sales, leads or return on ad spend.

7. Intellectual property

Once our fees have been paid in full, the ad content we create specifically for you may be used by you for your business. We keep the rights to our own methods, know-how and general materials. You keep all rights to the materials you provide to us.

8. Confidentiality

Each party keeps the other party’s non-public business information confidential and uses it only for the purpose of the engagement, unless disclosure is required by law.

9. Data protection

Each party complies with the EU General Data Protection Regulation and other applicable data protection law. Where we process personal data on your behalf, we will agree data processing terms with you. Our Privacy Policy explains how we handle personal data as a controller.

10. Liability

To the extent permitted by law, we are not liable for indirect or consequential loss, or for loss of profit, revenue or data. Our total liability under or in connection with an engagement is limited to the fees paid to us for that engagement in the 12 months before the claim arose. Nothing in these Terms limits liability that cannot be limited by law.

11. Use of this website

The information on this website is general information about our company and services. It does not constitute an offer. We may change the website at any time.

12. Governing law

These Terms and any engagement with us are governed by the laws of the Republic of Cyprus. The courts of Cyprus have exclusive jurisdiction over any dispute, unless a written agreement between us provides otherwise.
